HLA does not require every federate to try and create a federation.  However, as you pointed out, the federation must exist prior to joining a federation.  The RTI implements this constraint by throwing an exception ("Federation not found") if you try and join a federation prior to its creation.  Thus, you have two options:  Test for the federation and create it if needed prior to joining the federation, or try the join and be prepared to handle the "Federation not found" exception that will arise if you happen to try the join before some other federate creates it.
